The Central Organization of Trade Unions (Kenya), COTU (K), has thrown its support behind Brian Mwenda Njagi, a self-proclaimed lawyer who was recently detained for falsely presenting himself as an Advocate of the High Court of Kenya.
Brian Mwenda’s case took an unexpected twist as COTU (K) issued a press release, advocating for the Recognition of Prior Learning (RPL) principle. This principle recognizes and values the knowledge, skills, and competencies individuals have acquired through non-traditional learning pathways.
The detained lawyer reportedly won 26 cases before High Court Judges, Magistrates, and Court of Appeal Judges before his arrest. However, the Law Society of Kenya Nairobi Branch Rapid Action Team (RAT) apprehended him over the claims of false pretense, following public complaints.
COTU (K) sees Brian Njagi’s situation as a stark example of the challenges faced by talented individuals in Kenya who have expertise acquired through practical experience, self-study, and non-formal educational avenues. These individuals often find themselves excluded from formal sectors due to the emphasis on traditional qualifications.
Francis Atwoli, a seasoned labor leader and Secretary-General of COTU (K), spoke out about the issue, saying, “Brian’s case is not unique. I know of many great professionals in various fields without the paper qualifications to back their skills. COTU (K) calls upon the government of Kenya to take this opportunity to actualize Recognition of Prior Learning (RPL) in Kenya.”
COTU (K) not only expressed its strong support for Brian Njagi but also offered to assist him in realizing his dreams. This move has stirred a debate on the importance of recognizing practical skills and competencies in Kenya, highlighting the need for a more inclusive approach to qualifications and professional opportunities in the country.
