EACC Wants Controller of Budget Margaret Nyakango Charged Over Ksh.6B Telkom Buyout

The Ethics and Anti-Corruption Commission now wants Controller of Budget Margaret Nyakango charged over the controversial buyout of Telkom Kenya at a cost of Ksh.6 billion.

In its quarterly report, the EACC also wants former Treasury CS Ukur Yatani arrested and produced in court over several charges in the Telkom buy-out plan that includes money laundering.

The Director of Public Prosecutions (DPP) is reviewing the file of the Telkom buyout probe.

EACC has since established that during the buy-out plan, the Attorney General’s advice was ignored and his opinion was not factored in the contract with the Communication Authority (CA) also said not to have approved the acquisition of the 60 per cent shares thus the acquisition of shares by the government from Jamhuri Holdings did not meet the threshold.

“Our report has big cases…we have the Telkom case in that report,” EACC CEO Twalib Mbarak said.

The EACC has now recommended to the DPP that former Treasury Cs Ukur Yattani be charged in court over his role in the loss of the Ksh.6 billion.

Former Treasury PS Julius Muia is also listed among a group of former senior government officials that EACC wants to be prosecuted over the same.

In addition, EACC wants embattled Controler of Budget Margaret Nyakango charged over her role in the release of the colossal amount of money to aid the buy-out deal that happened a few days before the last general election.

Others whom EACC wants to be prosecuted include former director general public investments and portfolio management Eng. Stanley Kamau, Paul Cunningham who is the director of Jamhuri Holdings Ltd and CEO Telkom Paul Mugo Kibati.

Others include Telkom Board Chair Edward Njoroge, Julius Kiplangat Cheptiony, JHL transaction advisor John Ngumi, Kosi Ali and Alan Wainaina Kongo.

According to EACC, the chain of individuals lined up for prosecution should face among other charges economic crimes, abuse of office, money laundering and six counts of acquisition of proceeds of crime.

Early October, the Cabinet chaired by President William Ruto rescinded the decision to purchase a 60 per cent stake in Telkom from Helios investment at a cost of ksh.6.09 billion and now wants the company to refund the money.

The Helios Company at the centre of the Telkom takeover row is based in the UK while its partner/subsidiary Jamhuri Holdings Limited is based in Mauritius.
