- Chief Magistrate Lucas Onyina during the ruling of the case spoke that he had considered the submissions both by the prosecution, defence and victims.

The Nairobi court has today released Brian Mwenda on 200k cash bail.
Chief Magistrate Lucas Onyina stated that there was no compelling reasons presented before the court to have Brian Mwenda denied bail.
I agree with submissions made by defence lawyer Danstan Omari that there was no compelling reasons to deny the accused bail. I therefore release the accused on a bond of Sh300,000 or alternatively on a cash bail of Sh200,000 with one contact person, said the Magistrate.
The case will be mentioned on November 7.
The accused had been charged on Wednesday last week and detained at Industrial area prison.
Mwenda was last week arraigned and charged with six counts of uttering a false document, making a false document, as well as a practicing certificate.
He pleaded not guilty to all the charges before the Nairobi Chief Magistrate.
Through his lawyers John Khaminwa and Danstan Omari, the accused had asked the court to release him on favorable bail.
In an affidavit filed before Milimani chief magistrate Lucas Onyina, Mwenda says that he campaigned for LSK president Erick Theuri when he sought for LSK president adding that Theuri bailed him whenever he was arrested.
Theuri has on countless occasions used his powers as the law society of Kenya president to bail me, Michieka and other friends from different police stations whenever we were arrested for drinking-related issues, Mwenda states in his affidavit.
Mwenda has accused LSK of overstepping its mandate arguing that it’s a political season for the society adding that there exists cases of impersonation and the LSK leadership has never dealt with the said cases and participation the way they are dealing with his.
LSK should tell this court and members of the public what motivated them to present me as an advocate and if they earned some sort of financial benefit from doing so and when the same stopped. They sought revenge by exposing me, stated his affidavit.
On Thursday last week, the court allowed the Law Society of Kenya (LSK) to be part of Mwenda’s case.
Mwenda says that there’s evidence of his prowess and skills despite a lack of formal training.

In a different story, the embattled fake lawyer recently spoke for the first time since he was outed by LSK.
He claimed his story may be deeper than it is and may have a bigger purpose, like maybe being a politician in future.
I cannot disclose much due to the ongoing investigations, but all I can say is maybe this was for a greater purpose. Let’s see how it ends, and keep praying for me,” he said.
