Former Embu North DCIO Jervasio Njeru, charged with raping a suspect inside his office has been convicted by the High Court.
Jervasio Mwaniki Njeru was sentenced by High Court Judge Lucy Njuguna after the Director of Public Prosecutions appealed against the acquittal in March.
The decision to set aside the acquittal was made by Lady Justice Lucy Njuguna, who criticized trial Magistrate Henry Nyakweba for releasing Njeru despite sufficient evidence presented by the prosecution.
Njeru faced various counts of rape and abuse of authority, with the prosecution alleging that on May 31, 2020, at Manyatta Police Station in Embu, he intentionally and unlawfully raped a suspect without her consent. The charges also included an alternative count of inappropriate touching.
During the trial, the prosecution called 19 witnesses, including the complainant who detailed the harrowing incident. She recounted how Njeru took advantage of his position as a police officer, leading to the alleged assault. Despite the defense’s claims that the complainant was Njeru’s girlfriend, the judge sided with the prosecution.
The crucial testimony came from Dr. Phillis Muhonja of Embu Level 5 Hospital, who examined the complainant and confirmed injuries consistent with forceful penetration. The judge emphasized that these injuries provided clear evidence of non-consensual acts.
The judge condemned the trial court for disregarding key evidence, including medical reports and the analyst’s findings, which supported the charges against Njeru. The acquittal was set aside, and Njeru was found guilty and convicted of the offenses of rape and abuse of authority.
The decision marks a significant victory for justice, as the High Court rectifies what it deemed a miscarriage of justice in the earlier acquittal. Njeru now faces the prospect of a lengthy prison sentence, highlighting the serious consequences for those who abuse their positions of authority.
