High Court Halts Revocation of Jomo Kenyatta’s Gun License Amid Legal Battle

The High Court in Nairobi has intervened, temporarily blocking the government’s decision to revoke the firearm license of John Jomo Kenyatta, the son of former President Uhuru Kenyatta.

Justice Jairus Ngaah granted a stay on the revocation pending the resolution of the case filed by Jomo on Wednesday.

In a landmark ruling, Justice Ngaah emphasized, “Leave is granted for the preservation of the substratum of the suit, acting as a stay on the decision to revoke Jomo Kenyatta’s firearm license until due process is followed.”

The legal saga unfolded after a police raid on Jomo’s residence in Karen prompting him to seek legal recourse.

Jomo’s lawyer, Fred Ngatia, argued in court that the Firearms Licensing Board and Chief Licensing Officer had unlawfully canceled his client’s license without proper communication or a hearing.

Ngatia contended, “The applicant has been in possession of the license without any complaints of misuse. The government should have followed due process, summoning Jomo and providing a formal explanation for the intended revocation.”

Expressing concern over potential strong-arm tactics, Ngatia stated, “Jomo fears that such actions may attract undue publicity, compromising his safety and inviting criminal elements to target him in the absence of self-defense measures.”

Jomo, in an affidavit, recounted the events of July 21 when officers, allegedly acting on instructions from the licensing officer, demanded the surrender of his firearms, extending the order to his family.

The High Court’s decision grants a reprieve to Jomo Kenyatta, setting the stage for a legal battle that will determine the fate of his firearm license.

The case raises critical questions about due process and the balance between individual rights and government authority in matters of firearm ownership.
