Lawyer Omari Dismisses MP Ichung’wa’s Claims Of Dropping Case Against Him, Hearing Set For Next Month

Lawyer Danstan Omari has dismissed as false remarks made by National Assembly Majority Leader Kimani Ichung’wah claiming that he has withdrawn a case filed against him.

According to court documents seen by Citizen Digital, Milimani Commercial Court Presiding Magistrate Caroline Cheptoo ordered Ichung’wa to be served with the application and appear before the court within 15 days, further setting the matter for mention on June 23, 2023.

Upon considering the application; it is hereby ordered that the application is NOT Certified Urgent and that the application be heard inter Partes on 23/6/2023 given under my hand and seal of the Honourable court this 28/4/2023,” read the documents.

Whereas the above-named plaintiff has instituted a suit against you upon the claim, the particulars of which are set out in the copy of the plaint with annexures attached hereto. You are hereby required within 15 days from the date of service hereof to enter an appearance in the said suit.”

The court consequently notified Ichung’wa that in case he failed to appear for the hearing, the judgement would continue without him.

Should you fail to enter an appearance within the time mentioned above the plaintiff may proceed with the suit and judgment may be given in your presence,” stated the court papers.

This comes even as the Majority Leader on Thursday shared a document claiming Omari had dropped the suit.

Taking to Twitter on Thursday night, the MP lashed out at the lawyer accusing him of ‘intimidation’ for allegedly dropping a suit he filed against him last month, which the lawmaker alleged he was never served and only heard from the media.

“I am the last man to be intimidated and someone must desist from using my name for attention-seeking media theatrics! Prosecute cases in Court not in media houses!” Ichung’wah wrote.

The court documents by Musyoki Mogaka and Co. Advocates shared online by Ichung’wa read: “Take notice that the Applicant/Plaintiff herein gives notice and wholly intends to withdraw the Application and Plaint they filed dated 25 April 2023, pursuant to Order 25 Rule 1 of the Civil Procedure Rules 2010.”

Lawyer Omari sued the Kikuyu MP last month demanding Ksh. 11 million in damages over what he termed as defamation by Ichung’wa through a Twitter post.

In February, Ichungwa tweeted: “Phewl At least am known in Kikuyu by my people unlike the fake media-based liar only known along Koinange Street!”
