In a bold display of dissent, a group of impassioned youth flooded the bustling streets of Nairobi’s Central Business District (CBD) on Thursday, vehemently protesting the court-issued injunctions hindering the progress of the Affordable Housing Project.
Marching resolutely through iconic city thoroughfares such as Moi Avenue, Tom Mboya, and Kenyatta Avenue, the protestors echoed chants of ‘haki yetu’ (our rights), underscoring their unwavering support for the contentious Affordable Housing Project.
Armed with placards advocating for the housing levy, the demonstrators, comprising sand harvesters, architects, masons, and slum dwellers, passionately asserted their status as beneficiaries of the initiative.
The fervor of the protest stems from the High Court’s recent pronouncement, deeming the housing levy unconstitutional.
In a decisive ruling during the consideration of petitions challenging the Finance Act 2023, Justice David Majanja emphasized that the levy, introduced via an amendment to section 84, lacked a comprehensive legal framework, violating Article 10, 2 (a) of the constitution. He further asserted that the imposition of the levy on individuals in formal employment without justification was discriminatory and irrational.
Despite this setback, the court exercised a temporary reprieve by granting stay orders, postponing the annulment of the affordable housing levy until January 10, 2024. This extension came in response to a request by the Respondents involved in the case.
In the aftermath of the court’s ruling, various stakeholders have voiced their support for the High Court decision, with the government expressing its intent to appeal the verdict. The unfolding legal battle underscores the complexities surrounding the Affordable Housing Project and its far-reaching implications.
